Terms and conditions
1. Rexby ehf.
Rexby ehf. (hereinafter referred to as Rexby) is operating under a license from the Icelandic tourist board in accordance with Chapter III of Act no. 96/2018 on Icelandic Tourist Board and has corresponding duties and responsibilities according to Icelandic law.
The service subject to these terms and conditions are a package travel as defined in Act no. 95/2018 on package travel and linked travel arrangement.
Traveller shall therefore enjoy all the rights that applies to package travel. Rexby is fully responsible for the proper functioning of the travel package as a whole.
In addition to the above, Rexby has established insurance in accordance with Article 24 of Act no. 95/2018 further described below.
These terms and conditions are concluded in accordance with requirements under Icelandic Act no. 95/2018 on package travel and linked travel arrangements and Regulation no. 1286/2018 on standardized information in relation to package travel and linked travel arrangements.
2. Contact Person
Every group travelling with Rexby must appoint a contact person who is responsible for relaying all information to the group. The person will be appointed a contact person with Rexby.
3. Price of travel and payments
Price includes all taxes and fees unless otherwise stated.
Payments are handled through Payments shall be handled and processed through a payment gateway where customers are required to pay with credit card
25% deposit when confirming the trip.
30 days prior to arrival. The Traveller will be sent a final invoice to pay the final 75% of the balance due.
All payments shall be completed within 30 days of the first travel date. The first travel date being the beginning of the performance of travel services included in the travel package.
For travel packages, changes in fees (including transportation costs, fuel costs, dues, taxes and exchange rates and other fees recited in Paragraph 2 of Article 12 of Act no. 95/2018) and services mean that the price of traveller’s travel arrangements (or any part of them) may change after they have been booked. However, there will be no change to the cost of traveller’s travel arrangements within 20 days of departure. Should the price of traveller’s travel arrangements decrease due to the aforementioned changes any refund due will be paid to the traveller. We will deduct from this refund our administration expenses incurred.
In the event a traveller has to pay an increase of more than 8% of the price of the total travel arrangements (excluding insurance premiums and amendments charges), the traveller will have the option of cancelling and receiving a full refund of monies paid, except for any amendment charges and cancellation charges already incurred.
4. Insurance
Rexby provides insolvency protection for the refund of all payments made for a package which is not performed in accordance with the relevant contract, in the event of Rexby becoming insolvent or the suspension of their operations.
In the event Rexby becomes insolvent or their operation is suspended the traveller may contact Ferðamálastofa, Hafnarstræti 91, 600 Akureyri by telephone + 354 535 5500 or by email upplysingar@ferdamalastofa.is.
Rexby does not offer travel insurance and it is strongly advised that travellers take out a policy of insurance in order to cover against cost for example in the event of accident or illness; loss of baggage and money; and other expenses, as well as ensuring cover for any activities travellers have booked.
5. Changes by Rexby
Rexby is not responsible for unforeseeable changes to travel, for example due to changes in airline schedules. Rexby can change or abort trips in case of unforseeable and unavoidable situations that are beyond the control of the company.
Rexby may terminate a package and provide the traveller with a full refund, but without being liable for additional compensation, if:
- the number of persons enrolled for the package is smaller than the minimum number stated on the website and the organiser notifies the traveller of the termination of the package within the specified period, but not later than:
- 20 days before the start of the package in the case of trips lasting more than six days;
- 7 days before the start of the package in the case of trips lasting between two and six days;
- 48 hours before the start of the package in the case of trips lasting less than two days; or
- Rexby is prevented from performing the contract because of unavoidable and extraordinary circumstances and notifies this to the traveller without undue delay before the start of the package.
Rexby shall reimburse any payments owed to the traveller within 14 days of the termination.
5. When traveller cancel a trip:
- Before trip confirmation = 100% refund
- After trip confirmation 25% of the price is withheld by Rexby due to obligations to hotels etc.
- After trip confirmation and 90 days before the first day of travel = 75% refund
- Less than 90 days before the first day of travel = no refund.
- If the rules of cooperating airlines, accommodations etc. include stricter provisions then the provision of this Terms and Conditions the rules that are more restrictive shall be valid.
Traveller can cancel his booking without paying cancellation charges if the performance of the package travel is significantly affected by unavoidable and extraordinary circumstances. In such circumstances, Rexby will arrange for the traveller’s booking to be terminated and for him to receive a full refund.
6. Lack of performance and default remedies
Notification of lack of performance and Rexby ehf.’s obligation to take corrective action
The traveller shall inform Rexby without undue delay of any lack of conformity which he perceives during the performance of a travel service included in the package travel.
The traveller shall give Rexby a reasonable period to remedy the lack of conformity, unless this is impossible or entails disproportionate costs, taking into account the extent of the lack of conformity during the performance of a travel service and the value of the travel service affected.
If it is not possible to remedy the lack of conformity except by providing services of a lower quality than those specified in the package travel contract, the traveller shall be entitled to a price reduction corresponding to the difference between the agreed services and the services provided, unless Rexby proves that the lack of performance is attributable to the traveler.
If Rexby does not remedy the lack of conformity within a reasonable period or refuses to remedy the lack of conformity, the traveller may do so himself and request reimbursement of the necessary expenses from the organiser or retailer.
The traveller may not reject the remedy proposed by Rexby unless it results in services of lower quality than those agreed or if applicable the price reduction granted is inadequate.
7. Termination of package travel contract
In the event a substantial portion of the services specified in a package travel contract is not provided or is highly inadequate, the traveller may terminate the contract without any termination fee being charged by Rexby.
8. Price reduction
The traveller is entitled to a reduction in the price of a package for any period during which there was a lack of performance of the package travel contract, unless the lack of performance is attributable to the traveller.
9. Compensation for damages
The traveller may be entitled to compensation for any damage which the traveller sustains as a result of any lack of performance, unless the lack of performance is a) attributable to the traveller, b) attributable to a third party unconnected with the agreed services and is unforeseeable or unavoidable and c) due to unavoidable or extraordinary circumstances.
It shall be noted that Rexby may, in the package travel contract, limit the compensation they are required to pay under this article, in accordance with the limitations prescribed in other laws or international conventions that apply to specific travel services which are included in the package.
Rexby shall not be liable for any further compensation or financial liability due to damage which the traveller sustains than described above. For any avoidance of doubt, the limitation of liability of Rexby includes, but is not limited to, any personal injury or damages of the traveller, for example incurred during hiking or any other performance of the travel package, unless the injury or damages are a direct cause of lack of performance by Rexby as previously stated. Furthermore Rexby shall not be liable for repayments of the travel packages due to the traveller not being able to enjoy the Events of the travel, as further described in the package travel itinerary, whatever the reason may be, including any personal injury of any traveller incurring during the travel.
10. Transfer of package travel
Traveller may, after giving Rexby reasonable notice on a durable medium before the start of the package, transfer the package travel spot to another traveller who satisfies all the applicable conditions. Notice shall be given at the earliest convenience. Notice given at the latest seven days before the start of the package shall in any event be deemed to be reasonable.
The transferor and the transferee shall be jointly and severally liable for the payment of the balance due on the package and for any costs arising from the transfer. Rexby shall inform the transferor about the actual costs of the transfer. Those costs shall be reasonable and fair, and documents confirming such costs shall be submitted. Rexby shall only be entitled to demand payment equal to the actual cost incurred by them due to the transfer.
11. Responsibilities of customers and travellers
Travellers are responsible for knowing the terms and conditions of Rexby and service providers under the travel package contract.
Travellers are responsible for their passports being valid during the duration of their trip and their visa being valid for travel into the countries visited.
Rexby is never responsible for damaged or lost luggage and travellers must stake their claims directly to the airline according to international laws.
Travellers are responsible for showing up on time for their flight, bus trips and all organised events organised by Rexby. Rexby is responsible for giving the correct information to the travellers.
Travellers might visit places where caution is adviced (waterfalls, geysers, glaciers, boat trips) and are responsible for suitable behavior and care according to each situation.
Rexby and Rexby cooperating parties can refuse service to any person under the influence of drugs and/or alcohol. A person who demonstrates threatening or lewd behavior towards others can be removed from the trip and all costs due to such removal must be carried by this person.
If a traveller has complaints, special requests or messages in relation to the performance of the package travel, the traveller may address these directly to Rexby, at Rexby earliest convenience. The traveller may also directly contact Rexby during the performance of the package travel.
It is of the traveller’s responsibility to ensure that all necessary travel and health documents are in his possession before departure in addition to ensuring that the traveller meets any foreign entry requirements of Iceland.
It is of the traveller’s responsibility to have a full and valid passport and obtain required visas, if applicable. The traveller’s passport shall be valid for at least 6 months after the return date of the trip, as that is a general requirement in most countries.
It is the traveller’s responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates. Requirements do change and you must check the up to date position in good time before departure.
Traveller should consult a doctor for current recommendations and information on inoculations or vaccinations before you depart relevant to the destination the traveller will be visiting or transiting through to arrive to Iceland. It is the traveller’s responsibility to ensure that they are fit to travel and meet all health entry requirements, obtain recommended inoculations, vaccinations take all recommended medication and follow all medical advice before departure.
Rexby does not accept any responsibility if a traveller cannot travel, or incur any other loss because they have not complied with any passport, visa, immigration requirements or health formalities.
12. Notification of injury or damage
Should anything occur during a trip then it shall be reported to the contact person responsible at Rexby as soon as possible so that the damage can be limited as much as possible. If issues are not resolved in an agreeable manner then they shall be reported in writing to the CEO of Rexby within 30 days of the end of the trip. If this is not done then possible claims of compensation might not be considered.
Rexby is not responsible for personal valuables that might be lost or stolen during the trip. Suspected theft should be reported to the local police.
Rexby operates under Icelandic law and all cases brought towards the company that cannot be settled amicably shall be finally settled by the District Court of Reykjavik.
13. Disclaimers
Rexby can change Rexby terms and conditions at any time. If this is done, customers shall be notified immediately.
In case of an emergency the traveller shall contact Rexby at [+354 8469235].
If a traveller is in difficulty whilst travelling and ask Rexby to help Rexby will do its best to provide appropriate assistance, in particular by providing information on health services, local authorities and consular assistance; and helping the traveller to find alternative arrangements and any necessary phone calls/emails. The traveller must pay any costs Rexby incur, if the difficulty is not Rexby’s fault.
Rexby can adjust for and amend typing errors in any published material, online or on paper.
